So my car got hit while parked... again

So tonight while I was at work I got called outside because someone hit my car. It was parked and clearly visible but they claim it was in the blind spot. This is slightly annoying but not a big deal, been there done that. They did notify me and we talked about i.t Anyway the funny part is they are putting the blame on me. They claim that because my car wasnt technically in a parking spot in the parking lot of the restaurant I work at, which is privately owned so there is no legality on parking, I am at fault. The only reason I was parked there is all the other usual employee spots were taken and the store right across from us has threatened to tow us for parking there. And everyone does it, we just make sure to park behind other employees so we dont block in customers. And there arnt any no parking signs, or red or yellow paint, its just an open area of parking lot. Its total BS and I hope their insurance tells them that. I dont see his story holding any chance in court so I really dont want to deal with that except for the fact that I was to prove him wrong. Right before he left he shook my hand and said, "Im sorry you parked where you did." I want to see him told hes at fault and say, "Im sorry you thought your story had a chance in court."

Not really. Never has been before. And either way this guy still hit a parked car. Is it really that hard to miss? Haha

Yea I am definately saying that he is at fault and so will insurance.

Yeah exactly. I can kinda see his point, but out of the space or not he didn't see where he was going. And it's not like my car just got parked there after he did. It was there for hours all day and didn't move.

yeah his vehicle is a blind spot similar thing happened to me. I got hit with a blazer in my mint Saab C900 not a scratch or a dent everything worked perfectly all original mint leather interior and she totaled my car.

either way it's his bloody fault and he should own up it.

yeah, exactly. he claims that I was in his blind spot, but I know those trucks come with wide angle mirrors. And how could he not see my car when he originally parked there, or when he walked back out to his truck. It really doesnt matter how you try and spin the situation, he hit a parked car. If a kid was standing there and he hit the kid would the kid be to blame for standing there? No. A driver always has to have complete control and know where their vehicle is going and know the surroundings.

with insurance if the damage is worth more that 70-80% of the value of the car they will usuailly total the vehicle. insurance companies will do 1 of 3 things 1. pay the claim, 2. deny the claim, 3. pay the claim and total out the vehicle, and if they want to total it out here is the process to get the most money out of your car and screw over the insurance company in the process. also take it to skys/fix auto to get a repair quote they are the most expensive in town.
first use kbb.com enter your vehicle info and get the kbb private party in good condition.
then go to cars.com, autotrader.com and craigslist and any other car sale website and make sure that you do include dealer prices also, and find simularly equipped make and model of your car in your model year, and you can go a year older and a year newer as long as it is the same design, and the price does not change too much, go about 250 miles for the radius of the dalles.
then take the cars for sale and price from kbb.com print all of them off, and get ready to fax or e-mail to the insurance company.
also any work like new tires, wheels, aftermarket/custom parts that are recent add ons include invoices for that.

My car was hit a new mirror fender grille and front bumper was only a little over $1700 for parts and labor at skys. Btw I hate skys. They messed up so much on my car and on friends cars

A new door skin, and you're all set. You don't need an entire door, unless you got rust that runs along the bottom.


And I agree. A parked car is almost like a fixed object... if he didn't see it, he was NOT paying attention. Sucks to be him trying to explain that. I have had plenty customers on both sides of this fence, and the 1 that was parked ALWAYS won.

did you get your car fixed yet? other guy paying or are you going to have to pay out of pocket?

Other guys insurance is taking it. Took them over a week to contact the shop and it only happened cause I called the shop and asked them what was taking so long. they called the insurance and got things figured out. Estimate was over $1400. Just dropped it off yesterday and I'll get it back thursday at the latest. I get to drive this awesome chevy cobalt for the time being haha
