At first I was just stunned.. i had my windows up and it was getting smokey inside so when I got out and was all bending over coughing.

well the corner is a bit of a blind corner and what happened was we both went wide and when i saw him I tried to correct but it was slippery (I had snow tires on) and by that time it was too late.. I saw his yellow plow blade getting closer and closer until it hit and the air bags went off.

my engine stalled and I noticed my throttle was pinned wide open after I regained myself.. I took some pictures and me and him were chatting in the truck

Yeah airbags suck - I've disabled them on all my cars after my experience with them.

I just let the tires go.. no biggie plus my jack was bent from when the car rolled off it one day and I pretty much killed it when trying to do a lift when the car fell on the rotor.

I pretty much took everything out..

guy wanted to be funny and not give me a screw driver to take my dome light out (built custom light setup) so I just ripped the whole light out to save it..

JDM tails not saved.. JDM headlight drivers side smashed but passenger side is ok.. I was only able to save one hella horn.. other was smashed..

both JDM fogs smashed..

yeah man.. if was you who told me to check CL and I did and that same day I saw this car listed for $400.. I thought it was fake till I went to Brooklyn to check it out :( yeah man.. I waited almost 3 years....

thats a load of shit. all that happened to the truck was maybe a tweaked plow. should just leave it as is since now you need a new car. he can at least drive the truck

yeah the guy in the tuck told the cop he was not able to lift the plow because the chain broke but he was able to move it left or right... i thought I was fucking dreaming when i heard the voice mail message...

call your insurance company and have them tell you exactly what is in the estimate for the repair to the plow truck, and let them know what you saw at the scene and what he was able to do and what he said about what he said was wrong. not positive the i think the plow is mounted to the frame and that might be where the cost is, if he has frame damage.

Well technically, he left the scene of an accident, so he caused a hit and run. Another thing is he came and told police he couldn't work his plow, so clearly he's trying to get money out of it. Take it to court man!

Fight it. Plows hit crap all the time, and your impact might have been enough to be the "straw on the camel's back" but that doesn't make it your fault. That's like me suing the original builder of my 1964 house because they pointed it north west instead of south west and now rain comes in a window.

if you want to make sure he isn't screwing you over,
1. call your insurance company and make sure they know that he left the scene of the accident when the police showed up but continued plowing but came back to the scene when your car was being hooked up.
2. ask to speak to the geico fraud division.
you said in one of your original posts that he went wide and so did you.
did he go over the "center line" if so he would be considered 50% at fault.
a friend of my dad's went through a 4 way intersection (in California) with no stop signs. he and another guy collided in the middle of the intersection. the other guy drove away he was driving a flat bed delivery type of truck and my dads friend was in a 2500 ram, but even though the other guy left the scene, because it occurred in the middle of an intersection with no stop signs he has to make a claim on his "full coverage" on his truck to get his fixed because they said he was 50% at fault.

so i what i am trying to say is try to get it deemed 50% at fault for both parties at least, that way your insurance won't have to pay out. you would still get the points with 50% but you could screw the other guy over.
also in the police report does it say anywhere that he left the scene and came back? that could be a gold mine in court if it comes to that.

Yeah either fight it yourself, or call your own insurance company and have THEM fight it. Assuming you have insurance (liability at least) YOU aren't responsible for paying the 10k in damage, your insurance company is. And they won't pay it until they have determined that it really was your fault.

Not to sound like too much of a dick, but you admitted to driving wide (into his lane, I'd assume) around a blind corner. Assuming his plow is hydraulically controlled, a crash will tweak all the hydraulic cylinders and pretty much destroy the entire system. Also, the frame is also usually attached directly to the frame, so you may have damaged the truck's frame.

Additionally, you are required to have liability insurance, so your insurance will pay for his damages. If you didn't have collision coverage (sounds like you didn't) then they won't pay for any of your damages. Sucks, but its usually more cost effective than paying for collision coverage on a car with a replacement value of maybe $2000 on a good day.

when i go out for a walk I will take a picture of the area.. see no one runs wide (his direction) because of the small curb on the far right and for my direction people don't do the same for your side because of the same curb.. the fact that the road was untreated did not help at all.. The town ran out of money so they are relying on the state trucks to come to do the town but not after they do the highway.

I'm not worried about them paying for damages to my car.. it would of been totaled anyways the next car I will get collision on only because I'm spending more then $400.
