Update on stealing my car back from the towing yard

I know it's been awhile since I posted about my car getting towed when I ran out of gas. I just wanted to let everyone know what the outcome was. The DA ended up charging me with theft of services. Which is a misdemeanor of the second degree. Theft of services is described as "the defendant obtained a service with no intention of paying for the service provided". I plead not guilty because I never asked for any such service. They tried to tell me I abandoned my car even though the law states that it must be inoperable or unattended for a period of 48 hours before it is considered abandoned. It was actually going to go to a jury trial. Jury selection was going to be today however I received a letter from the DA that said all charges have been desmissed due to insufficient evidence. So I was right. They cannot just expect you to pay for towing when they had no right to tow it to begin with.

Wow. I am surprised that the legal ramifications are over... but I am wondering if you still have a balance due with the towing company???


I mean... right now they most likely have that invoice in their system... and right now it is not paid... Who do you think owes the bill?


Regardless of what your answer is, I would call the tow company just to make sure that you were Even-Steven on their side too. Last thing you want is to be explaining this to a collection company that doesnt give a shit 2 years from now.

If it was determined that the state erred in wrongfully towing the car, they should pay it.

But I agree - definitely call them up and make sure it's taken care of and you don't have anyone after you...

Oh, and Kudos for following the right path and not getting in bigger trouble. It worked out for you, and I'm glad :)
