So this isnt happening in my legacy but my other Subaru(SVX) so I figured it would be a similar resolve.( both have 4eat I believe)

When I turn the car on and push the brake so I can take the car out of park, it just clicks as if I dont have my foot on the brake. But then I lift and release the E-brake(which was not engaged when I park) and it will then let me shift out of park. Any suggestions to why this may be happening?? Thank you

Its most likely the shifter-lock system .

It works by using the brake pedal switch as a method to make sure that the transmission is in a safe state to select different gears.

The switch is located IIRC above the brake pedal so its either loose or damaged.

Check the FSM for the SVX.

FSM seem overwhelming but a quick skim through the pdfs will lead you to the braking system.

I don't know if Subarus do it, or if it helps, but my Corolla would engage the shift lock when the brake lights were out.

I know it's been a couple months but is there still a download of the SVX FSM available somewhere? It is the hardest thing to find. The link Chuck posted doesn't work anymore.
