Is it a must to be there, would it affect the fuel gauge operation, if that is wat it is i would suspect its for cold weather, here were im from it 80 to 90 degrees all year round

In looking at how it is held there... I guess it wouldnt be too bad to relocate it but all the fuel pump install instructions (from the manufacturers) have all mentioned to be very careful not to damage it. The one thing to note is that it is not resting against the pump itself. If you were to relocate it you might avoid zip tying it directly to the pump.
If you are asking if it would be OK to remove the entire sensor from the fuel pump/sending unit and re-install without it... I am nearly positive that there is a CEL code for the fuel temp sensor (input high/low I believe) that would be thrown.
No clue if that would cause limp mode on the ecu or not but I cant imagine you would get full timing advance/boost if the engine didnt know the temp of the fuel.

My car doesnt have one at all, but the new sending unit i just put in had the wires for it but i just cut them off, maybe it only comes on the USDM and EuroDM, not on the JDM

well i dont plan to, and i know the cel is working cause it came on when i had a bad knock sensor, if i could only find out know what the hell is making the gas gauge work erratic then everything will be just peachy, i changed both sending units and it still does the same thing, it will be showing that it has gas, if i full the car it goes to full and then all of a sudden it just drops back to the empty mark and rest on the pin and the gas light comes on, then when ur not lookin its back up again, i think i need to get it excorcized, lol
