Engine swap: 1998 Legacy L wagon EJ22 to
1999 Legacy Outback Wagon. Neither from California.

I am sure that the engine will fit one way or another,
but are there any emissions regulations issues?

Is there something about engine blocks and heads
being Phase 1 versus Phase 2 between 1998 and 1999?

Would you use the later engine's ECU,
or one from the later year same displacement?

No emissions issue. Don't know what state your in but if they ask about the engine tell them its from a 99.

Some 99 legacy have phase 2 blocks but still uses the phase 1 heads. Legacy didn't become full phase 2 till 2000. So your good on the engine. Same connectors/sensors.

Try the ecu you have now and see if you like it. Then try out the 2.2 ecu
